Terms and Condition

This policy is a part of our Terms of Use. By listing apparels items for sale through FAIYDA, you’re agreeing to this policy and our below Terms of Use. Hereinafter FAIYDA will be referred to as FIRST PARTY and (VENDOR NAME) will be referred to as SECOND PARTY.

For Perishable Items

  1. Purchase and supply of perishable products: FIRST PARTY will receive a purchase order from the end customer and place the request to the SECOND PARTY. The SECOND PARTY is responsible for ensuring the safe packaging of perishable products and handing it over to the courier person for delivery in accordance with the terms of this agreement.
  2. Product quality and hygiene: SECOND PARTY must ensure that raw materials are of good quality and maintains good hygiene standards while processing and packaging the perishable products. FIRST PARTY reserves the right of inspection of the kitchen at periodic intervals to examine hygiene practices.
  3. Labelling – SECOND PARTY must label each package with basic information about the product like; use of raw materials, date of packaging, expiry date, content, pricing and their own brand information. FIRSTY PARTY shall not be liable for packaging of the product for courier. However; FIRST PARTY may organize a small training session on quality packaging if asked by the SECOND PARTY.
  4. Payment Terms – FIRST PARTY shall make payment to SECOND PARTY for every product supplied within 15 days of order placement. i.e. if the order is placed with SECOND PARTY on 1st January, the payment to SECOND PARTY shall be due by 16th January. FIRST PARTY shall make the payment through online bank transfer and no cash transactions will be entertained. FIRST PARTY agrees to abide by this payment terms. Pricing of products will be mutually agreed upon between the FIRST PARTY and SECOND PARTY. For any revision in product pricing, second party must give a prior notice (15 days) to FIRST PARTY for such changes. Change in pricing is subject to agreement between both the parties.
  5. Delivery – All perishable products shall be delivered within “X” days of order. For urgent deliveries, the customer may choose Bluedart courier. All courier charges will be added to the purchase order and shall be paid by the customer only.
  6. Poor Quality Products – SECOND PARTY agrees that they will be responsible for supply of any poor-quality product. In situations of customer complaint about quality of product, SECOND PARTY shall be responsible for this. Payment to SECOND PARTY may not be processed in such scenarios of spoilt product.
  7. Product Return, Refund & Replacement – Product could be returned & replaced in cases like; spoilt quality, date of expiry and delivery of unsealed products delivered. Refund request to be entertained within 10 days of product delivery. For return/replacement/refund, one side courier to be borne by vendor (SECOND Party).

Apparels

  1. Purchase and supply of Apparels: FIRST PARTY will receive purchase order from end customer and place the request to SECOND PARTY. The SECOND PARTY agrees that they are responsible for ensuring safe packaging of apparels and hand it over to courier person for delivery in accordance with the terms of this agreement.
  2. Product quality and hygiene: SECOND PARTY agrees that quality of the apparels is thoroughly checked and there is no defect.
  3. Labelling: SECOND PARTY agrees that they will label each package with basic information about the product like; type of cloth, percentage mix of various cloth type like cotton, synthetic etc. pricing and their own brand information. FIRST PARTY shall not be liable for packaging of the product for courier. However, FIRST PARTY may organize a small training session on quality packaging if asked by the SECOND PARTY.

  4. Payment Terms: FIRST PARTY shall make payment to SECOND PARTY for every product supplied within 45 days of order placement. i.e. if the order is placed with SECOND PARTY on 1st January, the payment to SECOND PARTY shall be due by 16th February. FIRST PARTY shall make the payment through online bank transfer and no cash transactions will be entertained. SECOND PARTY agrees to abide by this payment terms. Pricing of products will be mutually agreed upon between the FIRST PARTY and SECOND PARTY. For any revision in product pricing, second party must give a prior notice (15 days) to FIRST PARTY for such changes. Change in pricing is subject to prior agreement between both the parties.

  6. Faulty products: SECOND PARTY agrees that FIRST PARTY shall not be responsible for supply of any faulty product. In situations of customer complaint about quality of product, SECOND PARTY shall be responsible for this. Payment to SECOND PARTY may not be processed in such scenarios of defective product.

  7. Product Return, Refund & Replacement: Product could be returned & replaced in cases like; size, manufacturing, defect and change in customer preference. Customers need to ensure clothes are returned in same condition as received without any perfume, cosmetic stains and all tags are intact. Refund request to be entertained within 10 days of product delivery. For return/replacement/refund, one side courier to be borne by vendor (SECOND Party).

Art Craft and Jewellery

  1. Purchase and supply of Jewellery: FIRST PARTY will receive purchase order from end customer and place the request to SECOND PARTY. The SECOND PARTY is responsible for ensuring safe packaging of jewellery and hand it over to courier person for delivery in accordance with the terms of this agreement.
  2. Product quality:  SECOND PARTY must ensure that jewellery quality is thoroughly checked and ensure there is no defect/damage.
  3. Labelling:  SECOND PARTY must label each package with basic information about the product like; what jewellery it is, elements it is made up of etc. pricing and their own brand information. FIRSTY PARTY shall not be liable for packaging of the product for courier. However, FIRST PARTY may organize a small training session on safe and quality packaging if asked by the SECOND PARTY.

Terms of Use

  1. Brand Management and Promotion: SECOND PARTY agrees and gives consent to FIRST PARTY for use of information like product images, content, pricing etc. on its website and other social media platforms for promotion.
  2. Maintaining stock: SECOND PARTY agrees that if product is out of stock, FIRST PARTY needs to be informed prior to such situation. IN case if new products are introduced or products are redesigned, or packaging is changed, FIRST PARTY will be informed immediately within 24 working hours.
  3. Courier of products: SECOND PARTY agrees that the product will be dispatched within 24 hours of order confirmation. Any delay in the courier will be sole responsibility of the SECOND PARTY.
    In case of any delay, the FIRST PARTY must be informed immediately (within 12 working hours) through call/text message.
  4. Governing Law and Consent to Jurisdiction and Venue:
    (a) Governing Law. This agreement, and any dispute arising out of the subject matter of the agreement, shall be governed by the laws of the State of Maharashtra.
    (b) Each party hereby irrevocably consents to the non-exclusive jurisdiction and venue of Mumbai, in connection with any matter arising out of this agreement or the transactions contemplated under this agreement.

SECOND PARTY agrees to abide by all above mentioned agreement clauses with FIRST PARTY.
